Heard R. Laxminarasimha Rao, learned counsel for the petitioner and Sri T. Venupogal, learned counsel for the respondent.

The Transfer Civil Miscellaneous Petition is filed under Section 24 of the Civil Procedure Code, 1908, by the petitioner, who is the wife of the respondent, seeking the Court to withdraw the Restitution Conjugal Rights petition filed by the petitioner herein/respondent, in H.M.O.P.No.34 of 2025 pending on the file of the learned Senior Civil Judge, Medpalli and transfer to the Family Court-cum-IV Additional District and Sessions Judge, Karimnagar. H.M.O.P.No.34 of 2025 was

filed by the respondent-husband under Section 9 of the Hindu Marriage Act, 1955 seeking Restitution of Conjugal Rights against the respondent-wife.

Learned counsel for the petitioner submitted that notice was served on the learned counsel for the respondents; however, there is no representation. It is deemed that the respondents have no objection to the Tr.C.M.P. 4.

Keeping in view the convenience of the petitioner as she is residing at karimnagar town, since, the other connected and M.C and DVC are also filed in the same Court at Karimnagar, the H.M.O.P. 34 of 2025 is transfer to the learned Senior Civil Judge at Medpalli to the file of the Family Court-cum-IV Additional District and Sessions Judge, Karimnagar. 5.

Accordingly, the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.34 of 2025 stands transferred from the file of the learned Senior Civil Judge, Medpalli to the file of learned Family Court-cum-IV Additional District and Sessions Judge, Karimnagar. The Court concerned is hereby directed to transmit the entire case file relating to H.M.O.P.No.34 of 2025,

after duly indexed, within a period of One (1) month from the date of receipt of a copy of this Order, under intimation to the other side. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this petition, shall stand closed.
