HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.31979 of 2016 ORDER:
Vide present writ petition, the petitioners seek a direction, thereby declaring the action of the respondents in not paying the compensation to their lands proposed for land acquisition for Solar Power Project at Sakunala Village, Orvakal Mandal, Kurnool District, as illegal and arbitrary.
2. It is stated in the writ affidavit that the petitioners are the absolute owners and possessors of the lands in Sy.No.573/ 4 an extent of Ac.1.94 and in Sy.No.574/ 2 an extent of Ac.2.80 of the 1st petitioner and lands in Sy.No.574/ 2 an extent of Ac.4.50 of the 2nd petitioner in Sakunala Village of Orvakal Mandal, Kurnool District. It is submitted that the petitioners have served first legal notice to the respondents on 13.06.2016 through their counsel and the second notice to the 4th respondent on 25.07.2016 to pay the compensation to the petitioners quoting full particulars of the said lands. However, till date the said respondents have not taken any decision.
3. Learned Government Pleader for Land Acquisition (AP), who accepted the notice on behalf of the respondents, has assured this court that decision shall be taken on the notices mentioned above made by the petitioners within the time stipulated by this court.
4. Keeping in view the averments made in the writ petition and the submissions of the learned counsel for both parties, I hereby direct the respondents 4 and 5 to take appropriate action on the legal notices noted above made by the petitioners through their counsel, within a period of four weeks from the date of receipt of a copy of this order.
The decision taken thereon shall be communicated to the petitioners in writing within one week thereafter.
5. Needless to state if the petitioners are aggrieved by the action or inaction of the respondents, they are at liberty to approach appropriate forum.
6. With the above direction, the writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed.
