THE HON'BLE SRI JUSTI CE P.NAVEEN RAO W .P.NO.4 6 3 3 9 OF 2 0 1 6

O R D E R

Petitioner retired from service as Inspector of Police.

Disciplinary proceedings initiated against him while he was in service, resulted in issuing show cause notice dated 15.09.2015, calling for his explanation on the proposed punishment of five per cent cut in pension for a period of two years. Petitioner claims to have submitted his explanation on 3.10.2015. In this writ petition, petitioner alleges that so far no final orders are passed after his explanation is filed. Since the show cause notice was issued and petitioner filed his explanation, without expressing any opinion on merits, the writ petition is disposed of at the stage of admission, directing the 1st respondent to pass orders duly considering the explanation of the petitioner dated 3.10.2015, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

In addition to the grievance of not finalizing disciplinary proceedings, in this writ petition, petitioner also seeks further reliefs i.e., treatment of the period of suspension, as on duty; awarding of notional promotions on par with his juniors and; revision of pay and other consequential benefits.

Since the present issue is at the stage of consideration of the explanation on the show cause notice issued on 15.09.2015, no opinion can be expressed on the said claims and they are left open for

the petitioner to agitate as and when final orders are passed by the Government, if he is aggrieved of the said final orders. No order as to costs.

Miscellaneous petitions pending if any, shall stand closed. ------------------------------------ P.NAVEEN RAO,J DATE: 25-01-2017 AVS
