THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 10132 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/Accused Nos.1 to 4 seeking anticipatory bail in the event of their arrest in connection with Crime.No.642 of 2023 on the file of P.S. Jangoan Police Station, Warangal, registered for the offences punishable under Sections 294-B, 323, 324, 506, 509 r/w 34 of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The de facto complainant filed a written complaint stating that on the previous day, these petitioners, who are relatives have trespassed into their house and assaulted. There were money disputes in between de facto complainant's husband and accused no.1, who are brothers.

Keeping in view, there were money disputes between the de-facto complainant and the petitioners, for which reason altercation took place, this Court is inclined to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioners/Accused Nos.1 to 4 are directed to surrender before the Station House Officer, Jangoan Police Station, Warangalon or before 20.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) each with two sureties for a like sum each to their satisfaction.

2) On such release, the petitioners/Accused Nos.1 and 3 shall appear before the concerned police on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required. However, the petitioners/accused Nos.2 and 4 shall appear before the concerned police, as and when required for the purpose of investigation.

3) The petitioners/Accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 438(2) of

Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
