Heard learned counsel for the petitioners, Government Pleader for Municipal Administration and Urban Development and Sri Venkateswarlu Nimmagadda, learned Standing Counsel for Nuzvidu Municipality.
There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits.
The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not implementing the "Technical Layout Pattern" which has been duly approved by the DTCP in relation to R.S.Nos.591/P, 592/1, 2, 593/1 to 4, 5A, 5B, 5C and 594/1, 3, 3B, 598/1, 2, 1B, 1C, 2B and 600/2 to an extent of Ac.37.95 cents in Ward No.13 of Nuzividu Town, as illegal, arbitrary and abuse of process of law; and consequently direct the second respondent to implement the undertaking vide ROC.No.94/2014-G, dated 05.02.2014 and follow the technical layout vide Lr.D.Dis.No.9214/10/R-1, dated 15.07.2011.
Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the second respondent to consider the representation dated 12.05.2016 made by the second petitioner. Learned Standing Counsel for Nuzvid Municipality submits
that if the said representation is pending, the same will be considered in accordance with law.
Having regard to the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed of directing the second respondent to dispose of the representation dated 12.05.2016 made by the second petitioner, in accordance with law, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of the order, if the same is still pending consideration. It is needless to mention that the second respondent shall hear the petitioners and also the un-official respondents before passing any orders on the representation dated 12.05.2016. No order as to costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand dismissed. _________________________ JUSTICE C. PRAVEEN KUMAR 07.06.2016 gkv
