Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioner submits that the application made by the petitioner to convert the agricultural land into to non-agricultural purpose was rejected by the 3rd respondent-RDO, Chittoor, without conducting enquiry and without issuing notice to the petitioner and no opportunity was given before rejecting his application. Though learned Assistant Government Pleader for Revenue submits that an appeal lies against the order of rejection, a reading of the impugned order dated 21-11-2013 goes to show that no opportunity of hearing was given to the petitioner before rejecting the application of the petitioner.

In view of the same, the impugned dated 21-11-2013 passed by the 3rd respondent is set aside and the matter is remanded to the 3rd respondent for consideration afresh and to pass orders thereon in accordance with law.

In the result, the writ petition is allowed to the extent indicated above. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J Dated: 01-02-2017 Nrg
