THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23363 of 2016 ORDER:
1 This Writ Petition is filed under Article 226 of the Constitution of India seeking writ of Mandamus, declaring the action of the respondent Nos.2 and 3 in interfering with the petitioner's peaceful possession and enjoyment of the Endowment land situated in Sy.No.457 to a extent of Ac. 2.00 cents of Gajuladinne village, Gonegandla Mandal, Kurnool District which was leased out by the respondent No.4 herein to the petitioner as being illegal, arbitrary and consequently direct the respondent Nos.2 and 3 herein not to interfere with the peaceful possession and enjoyment of the aforesaid land by the petitioner. 2 Heard the learned counsel for the petitioner and the learned Assistant Government Pleader representing the contesting respondent Nos.2 and 3.
3 The case of the petitioner is that he has been in possession and enjoyment of land to an extent of Ac. 2.00 cents situated in Sy.No.457 of Gajuladinne village, Gonegandla Mandal, Kurnool District, which belongs to the Endowment Department i.e. respondent Nos.4 and 5 herein. It is his further case that he has been paying maktha to the Endowment department.
4 The learned counsel for the petitioner submitted that the respondent Nos.2 and 3 are interfering with the peaceful possession and enjoyment of the petitioner over the above said land. The learned counsel in all fairness submitted that the Irrigation Department has vacant land in Sy.No.456 of the village.
5 The learned Assistant Government Pleader submitted that the respondent Nos.2 and 3 are not interfering with the peaceful possession and enjoyment of the petitioner over the land to an extent of Ac.2.00 situated in Sy.No.457 of Gajuladinne village, Gonegandla
Mandal, Kurnool District.
6 In view of the submissions made by the learned Assistant Government Pleader, this Writ Petition is closed. No order as to costs. As a sequel, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
