THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13461 of 2009 ORDER:

This writ petition is filed declaring the action of the respondents in trying to demolish/dispossess the petitioner from property bearing premises No.7-1-627/1, admeasuring 232 sq.yards, situated at Bapunagar, near S.R. Nagar, Opp: T.B. Hospital, Hyderabad, as illegal and arbitrary. Learned counsel for the petitioner submits that he is unable to contact his client and he requests for passing appropriate orders based on the material available on record. In the counter-affidavit filed by the respondents, it is stated that subject property is not found in TSLR and is constructed on the Government land; that in view of the fact that Metro Rail works were taken up and as the subject land has to be acquired, the authorities of the Corporation approached the petitioner for a negotiated settlement and that after considering the value of the subject property, the Corporation agreed to pay a sum of Rs.1,04,40,000/- towards land value and a sum of Rs.1,77,346/- towards value of structures and after deducting income-tax, the Corporation issued a cheque for a sum of Rs.93,64,680/- towards

CKR, J WP.No.13461 of 2009 ex gratia compensation for the subject property and obtained a receipt to that effect.

In those circumstances, the writ petition is closed. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
