ORDER
Heard Mr.Mahadeva Kanthrigala for petitioners and Mr.A. Rama Rao, learned Standing Counsel for respondents. On 07.02.2014, this Court restrained the respondents from collecting licence fee during the agitation period pending further orders.
The respondents filed W.V.M.P.No.1 of 2018 denying any obligation on the part of contract to reduce lic ence fee. To the pointed query of the Court to Mr.Mahadeva whether this Court can direct respondents to discharge an obligation not provided for in the contract, he fairly states that parties are bound by terms of contract. He is since unable to make out a case for issuing necessary directions to respondents, seeks liberty to petitioners to pay licence fee for the agitation period within two months from today.
The request of Mr.Mahadeva as an exceptional case is accepted.
The petitioners are given liberty to pay licence fee for the agitation period within two months from today. The petitioners, if do not pay licence fee within the stipulated period, the
respondents can recover licence fee from petitioners in accordance with law.
The writ petition is disposed of accordingly. No order as to costs.
