THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.10136 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.7 in Crime.No.927 of 2023 on the file of Miyapur Police Station, Cyberabad, registered for the offences under Sections 302, 307, 498-A, 120-b r/w. 34 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

On the basis of the complaint of one M.Siresha on 18.08.2023 alleging that her husband and relatives were responsible for causing the death of her mother and also tried to poison her, the crime was registered for the offences under Sections 302, 307, 498-A, 120-b r/w. 34 of IPC.

This petitioner herein is watchman's son of the Gokul plots, where the de-facto complainant and her husband stayed after their marriage. It is alleged that he was complicit in mixing the arsenic poison in the food of the defacto complainant and other family members. The mother of the de-facto complainant died due to poisoning. 5.

On instructions, learned Additional Public Prosecutor would submit that as on date, the investigation does not reveal that there was any poison that was found either in the body of the dead person or in the body of the complainant and others.

Keeping in view the said submission of the learned Additional Public Prosecutor, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:

i) The petitioner/Accused No.7 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of VIII Additional Metropolitan Magistrate, Kukatpally, Cyberabad.

ii) The petitioner/Accused No.7 after release shall appear before the concerned Station House Officer on every Monday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.7 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
