HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26073 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents 2 to 4 in not taking any action against the sixth respondent.
2. Heard the learned counsel for the petitioner, the learned Government Pleader for Irrigation and Command Area Development and the learned Government Pleader for Revenue(Andhra Pradesh).
3. A perusal of the record reveals that the official respondents 1 to 5 entrusted the earth work to the sixth respondent in respect of ayacut of BMD canal. The total value of the contract work is around Rs.8.00 lakhs. The contention of the learned counsel for the petitioner is that the sixth respondent has not properly executed the work, therefore, it is not entitled to receive the bills from the respondent.
4. The learned Assistant Government Pleader submitted that the petitioner herein kept quiet for a long time and submitted a representation to the second respondent on 04.07.2016 for the reasons best known to him.
5. At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 04.07.2016.
6. In view of the submission made by the learned counsel for
the petitioner, this Court is not inclined to go into the merits of the main case.
7. Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation of the petitioner dated 04.07.2016 in accordance with law, as expeditiously as possible, preferably, within a period of three months from the date of receipt of copy of this order.
8. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
