THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20543 OF 2017 ORDER:
This writ petition is filed seeking to issue a writ of Mandamus to declare the action of the 2nd respondent in not finalizing the LRS applications though the said applications are submitted on 10.04.2012 and 30.01.2016 in respect of the plot bearing No.49, admeasuring 350 square yards, situated at Sai Sri Colony, in Sy.No.100, Kondapur Village, Serilingampally Mandal, R.R. District, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that he is the absolute owner and possessor of the abovementioned plot. He intended to construct a residential house in the said plot and approached the 2nd respondent for construction permission.
The 2nd respondent informed the petitioner that the said plot is determined as surplus, and advised him to get no objection certificate from the office of the Urban Land Ceiling, Hyderabad. Accordingly, the petitioner obtained NOC from the competent Authority, Urban Land ceiling, Hyderabad. In the meantime, the Government issued orders for regularization of the plots in unapproved layouts. Pursuant to the same, the petitioner submitted an application to the 2nd respondent duly paying the requisite fee of Rs.5,000/ -, and the 2nd respondent also acknowledge the same. Though the said application was submitted on 10.04.2012, no orders were passed by the 2nd respondent. Subsequently, the 2nd respondent directed the petitioner to submit another LRS application through online payment of Rs.10,000/ -.
Accordingly, the petitioner submitted another application on 30.01.2016.

The grievance of the petitioner is that though he submitted the LRS applications long back, along with the requisite fee, the 2nd respondent is not passing any orders so far, and in the meantime, the neighbours are trying to encroach his plot. Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:
" The 2nd respondent is directed to consider the LRS applications, dated 10.04.2012 and 30.01.2016 submitted by the petitioner and take appropriate decision in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order." With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending if any, shall stand closed.
