HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27527 of 2017 ORDER:
This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking to suspend the action of the 2nd respondent in removing petitioner from service as a conductor without proper appreciation by ignoring the findings of enquiry officer though there is right of appeal since the order of removal, on the face of it as illegal, arbitrary, and unconstitutional and consequently set aside the order of removal, dated 12.06.2017, vide proceedings No.02/95(19)/17-TPG and to direct the 2nd respondent to reinstate petitioner into the service.

When the matter is taken up for hearing, it is stated by Sri S.V. Ramana, learned Standing Counsel for the respondents that there is an effective remedy of appeal against the impugned order, dated 31.05.2017, and the same is not disputed by the learned counsel for the petitioner.

In view of the same, I do not see any reason to entertain the writ petition and accordingly, the writ petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed granting liberty to the petitioner to avail the alternate remedy of appeal available to the petitioner under law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
