THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8209 OF 2022 ORDER:

This criminal petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.6 in connection with crime No.183 of 2022 on the file of Station House Officer, Gadwal Town Police Station, Jogulamba-Gadwal District, registered for the offence punishable under Section 370-A (2) of Indian Penal Code and Section 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956. 2.

Heard the learned counsel for the petitioner/Accused No.6 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Brief the facts of the case are that on 07.08.2022 the police personnel received information about running of brothel house in a rented house building belonging to one Azeem and on the same day they conducted raid along with the mediators and staff after obtaining permission from SDPO, Gadwal and arrested accused

Nos.1 to 4 who are present in the said brothel house. Basing on the confession, accused Nos.6 to 8 were arrested. 4.

Learned counsel for the petitioner submits that pursuant to the confession of Accused Nos.1 to 4, this petitioner was arrested. 5.

Learned Assistant Public Prosecutor submits that as per the confession of accused Nos.1 to 4, Accused Nos.6 to 8 aided accused No.1 in running the brothel house and also sending customers on commission basis.

The petitioner is in jail since 22.08.2022 and there are no other cases pending in which the petitioner is involved, for the said reason, the petitioner can be granted bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.6 is granted bail subject to the following conditions:

i) The petitioner/Accused No.6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial Magistrate of First Class, Gadwal.

ii) The petitioner/Accused No.6 shall appear before the Station House Officer, Gadwal Town Police Station, Jogulamba-Gadwal District on every Monday between 10.00 a.m. and 1.00 p.m. for a period of eight (08) weeks.

iii) The petitioner/Accused No.6 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 20.09.2022 ns
