HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 24094 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the respondents 2 to 7 in interfering with the possession and enjoyment of the petitioner's land admeasuring an extent of 286 sq.yds at Door No.17-1-127/A in Sy.No.567/12, situated at 24th Ward, Narsapur, West Godavari District, A.P and taking steps to dispossess the petitioner from part of the said land under the guise of formation of National Highway No.214-A, without due process of law as illegal and arbitrary.

Heard learned counsel for the petitioner, Sri S.S.Varma, learned Standing Counsel for 1st respondent, learned Assistant Government Pleader for Land Acquisition appearing for respondents 2, 4 and 6.

Learned Assistant Government Pleader for Land Acquisition, basing on written instructions submits that before initiating any action against the land of the petitioner, they will follow due process of law.

Recording the submission of the learned Assistant Government Pleader for Land Acquisition, the respondents are directed not to dispossess the petitioner, without following due process of law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
