HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5469 OF 2015 ORDER:
This Criminal Petition is filed by the petitioner/A1 under Section 482 Cr.P.C to direct IV Additional Judicial First Class Magistrate, East Godavari District, Kakinada to dispose of C.C.No.315 of 2010 within the stipulated time, preferably within three months.
Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the State before notice to respondent No.2/de facto complainant and before admission.
The petitioner is accused in the above said C.C. and charges leveled are for the offence punishable under Sections 406 and 420 r/w 34 I.P.C. and the case is pending for the last five years. According to the petitioner, there is no progress but for examination of PW.1 in the trial Court and the prosecution is simply dragging on the matter to make the petitioner and the other accused to go round.
Having regard to the above, this criminal petition is disposed of directing the learned Magistrate to conduct the proceedings preferably day to day as per the letter and spirit of Section 309 Cr.P.C. and dispose of the case,
preferably within three months by giving priority as the case is of the year 2010. If the same is not disposed of within three months, the learned Magistrate is at liberty to seek for extension of time, subject to the reasons. Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
