THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24681 of 2018 ORDER:

The petitioners pray for the following relief: "......WRIT OF MANDAMUS declaring the action of respondents, particularly 4th respondent in insisting the petitioners to vacate from their respective house site properties covered by S.Nos.605/2 and 599/1 of Pedapalakaluru Revenue Village in Guntur Mandal, Guntur District, without deciding petitioners' statutory appeals pending on the file of 3rd respondent filed against proceedings in Rc.No.900/2003-D dated 05.05.2005 passed by the 4th respondent, as illegal, irregular, irrational..........." The petitioners filed appeals against the order of resumption dated 05.05.2005 and the appeals are admittedly pending before respondent No.3.

The Assistant Government Pleader on instructions from the 3rd respondent informs the Court that appeals filed by the petitioners are listed for hearing on 30.07.2018 and the appeals are examined on merits and disposed of, not later than 07.09.2018.

The statement is placed on record and accepted. The petitioners apprehend creation of 3rd party interest or dispossession from the respective plots allotted to petitioners. In the fitness of things and to meet the ends of justice, both the parties are directed to maintain status quo

as regards possession and physical features as on date till 15.09.2018. The petitioners are given liberty to file memo seeking a date for hearing and disposal, by enclosing a copy of this order. No order as to costs.

Writ petition is accordingly disposed of. No order s to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
