THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24647 of 2018 ORDER:

Heard Mr.I.Koti Reddy for petitioners and the learned Assistant Government Pleader for respondents. The written instructions dated 18.07.2018 received from respondent No.4 is placed on record and by reference to written instructions, the writ petition is disposed of. The petitioners challenge alleged illegal and unauthorized interference by respondents in the enjoyment of plot Nos.35, 352, 167 & 136 in Sy.Nos.151A & B, as illegal and unconstitutional.

Mr.Koti Reddy referring to written instructions submits that petitioners may not be interested in challenging the alleged resumption order dated 31.10.2014, the 3rd and 4th respondents if assign plots to petitioners, as stated in the written instructions dated 18.07.2018. The Assistant Government Pleader requests the Court to excerpt the following paragraphs from the written instructions.

"It is submitted that the house less poor persons have to be identified and to issue house site pattas to the eligible persons. It is submitted that at the time of preparation of genuine list of the persons who are in need of House Site pattas for eventual allotment of the House Sites afresh.

Aggrieved by this, that the petitioners have filed Writ Petition before the Hon'ble High Court of Andhra Pradesh, Hyderabad. It is submitted that at the time of enquiry it is noticed that the petitioners are eligible to issue of house site pattas. Hence the house site pattas will be distributed to the above petitioners at the time of distributions of house site patta in Sy.No.151A & B of Kalludevanahalli village of Bommanahal Mandal."

Writ petition is accordingly disposed of and the 3rd and the 4th respondents ensure that the statement made before this Court is adhered to, at the time of assignment of house plots in Sy.Nos.151A & B. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
