HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24676 OF 2018 O R D E R :

The grievance of the petitioner is that the vehicle in which the petitioner's consignment was being transported, met with an accident and a case is registered in Crime No.505 of 2016 under Section 304-A IPC, dated 01.12.2016. Subsequently, when the petitioner filed Crl.MP.No.116/2018 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Sangareddy, seeking for release of the stocks in the crime vehicle, the same is dismissed by the said magistrate on 21.05.2018 stating that only vehicle is produced before the Court and that the said vehicle was also released vide order dated 19.07.2017 in Crl.MP.No.173 of 2017 in Crime No.505 of 2016. Aggrieved by the same present writ petition is filed.

Learned Assistant Government Pleader for Home produced written instructions stating that there is no justification in retaining the stocks seized from the vehicle involved in the crime, more so, when the vehicle itself is released in favour of the owner.

In view of the same, the 3rd respondent is directed to release the stocks belonging to the petitioner which were seized in relation to Crime No.505/2016, forthwith.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 20.07.2018 t k.
