HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 10686 of 2009 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in proposing to hold public auction for cultivation of the wet land of Ac.9.05 cents in R.S.Nos.105 and 110, situated at Ganapavaram village, Ganapavaram Mandal, West Godavari District belonging to the 1st respondent Devasthanam on 29.05.2009 as illegal and arbitrary and consequently to direct the respondents to lease out the above said land to the petitioner for another three years from Sarva 2009-10 to Dalva 2011-12 on the same terms and conditions on which the said land was leased out to him for three years from 2006-07 to 2008-09.

2. Though this writ petition was admitted on 29.05.2009, no interim order was passed.

3. The proposed auction notification was issued for granting lease for a period of three years i.e., from 2009-10 to 2011-12 and the said period has expired by efflux of time. In view of the same, the cause in the writ petition does not survive for consideration.

In view of above, this writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand dismissed. _________________________ A.RAJASHEKER REDDY, J 18.09.2015.
