THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2071 of 2016 ORDER :

Heard the learned counsel for the petitioners/A.3 to A.5, 9 and 10 and the learned Public Prosecutor.

2. The petitioners/A.3 to A.5, 9 and 10 filed the present application under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.111 of 2015 of CCS Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420, 468, 471 and 120 (B) read with 34 IPC.

3. The gist of the prosecution case is as under: On 09.05.2015 a complaint was received from L.W.1-Chief Manager of Central Bank of India, wherein it is stated that it has come to his notice that the accused persons have taken loans from their branches in their names and in the names of their relatives and friends by adopting fraudulent methods and using forged and false documents with criminal intention to cheat the bank, causing huge loss to public money and to misappropriate the subsidy amount given by the Khadi and Village Industries Board. Basing on these allegations, the present crime came to be registered.

4. Learned counsel for the petitioners submitted that A.1, A.2 and A.11 and A.12 were arrested and remanded to judicial custody on 27.01.2016. A.1 was released on bail on 30.01.2016, whereas A.2, A.11 and A.12 were released on bail on 03.02.2016.

5. Though the petitioners herein are women, having regard to the nature of offences and as huge amount of public money is being diverted using fake and fabricated documents, the request of the petitioners for grant of Anticipatory bail cannot be considered

6. Accordingly, the Criminal Petition is dismissed. However, the

petitioners/A.3 to A.5, 9 and 10, if so advised, shall surrender themselves before concerned Court and make an application for grant of bail, after giving prior notice to learned Public Prosecutor, in which event, the same shall be dealt with in accordance with law either on the same day or at the earliest.
