HON'BLE SRI JUSTICE S.V. BHATT W.P. No.13912 OF 2013 ORDER:

The petitioner prays for the following relief: "...Mandamus under Article 226 of the Constitution of India declaring the action of the 1st respondent in harassing the petitioner and his family in the guise investigation in cases registered against others as arbitrary, illegal and unconstitutional violating Articles 14, 16, 16 [4] of the Constitution of India and issue consequential directions, directing the respondents not to harass the petitioner and his family members, except according to the procedures of law..."

The Assistant Government Pleader on written instructions submits that the writ petition is filed on mere apprehension. As on the date of receiving instructions, no case is registered against the petitioner. Hence, there was no interference. It is further stated that if the petitioner is required in a pending case or any case registered against the petitioner, the respondents will follow the procedure while calling the petitioner to Station or investigating the offence.

The statement is placed on record and the writ petition is dismissed. No order as to costs.
