THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8322 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A1, seeking to grant anticipatory bail in Cr.No.116 of on the file of Neredcherla Police Station, Suryapet District, registered for the offences under Sections and IPC.

Heard learned counsel for the petitioner/A1, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The case of the prosecution is that the petitioner/A1 and other accused induced the de-facto complainant through deceitful words that they were having Dubai gold and they will give the same at cheaper rate and believing their words, himself and his brother-inlaw gave a sum of Rs.2,00,000/-each i.e., Rs.4,00,000/- to the accused, later the accused took them to Akuveedu Village of West Godavari District and gave small rings. Subsequently, they came to know that those rings are gold coated fake rings and when they informed the same, the accused postponed the matter since six months.

Learned counsel for the petitioner/A1 submits that the petitioner has been falsely implicated in the crime by the police and the petitioner neither collected money from the de-facto complainant nor took him to West Godavari District. He further submits that the

present complaint is filed in order to extract money illegally and that there is no explanation for the delay of more than 6 months in filing the complaint. He further submits that the petitioner a law abiding citizen and permanent resident of Miryalaguda and that he is ready to furnish sufficient sureties to the satisfaction of the Court and he shall abide by any condition imposed by this Court. 5.

Learned Additional Public Prosecutor opposed the relief sought in the petition.

As seen from the contents of the FIR, there are specific allegations against the petitioner that he along with the other accused by deceitful means have received a sum of Rs.4,00,000/- from the de-facto complainant and his brother-in-law saying that they will give Dubai gold at cheaper rate. They also took the de-facto complainant to Akuveedu Village of West Godavari District and gave small rings, which were found to be gold coated rings, thereby cheated the de-facto complainant. Thus, in view of the nature of allegations leveled against the petitioner/A1 and his involvement in the crime, this Court is not inclined to grant anticipatory bail to him and his prayer for anticipatory bail is refused. 7.

Hence, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
