THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.29580 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to direct the respondent No.1 to investigate in crime No.103 of 2015 and file investigation report in the court." Heard Sri M. Venkataramana, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, written instructions, dated 22-09-2015 furnished by the Sub-Inspector of Police, Abid Road Police Station, Hyderabad have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"... ... ...

It is pertinent to submit that the fair and impartial investigation is going on in all angles to find out the guilt of the accused. Almost all the averments made in the affidavit filed in support of the writ petition are the subject matter of investigation in CrNo.103/2015, dt.14.4.2015 for which the detailed investigation is under hectic progress. I humbly submit that I assure to this Hon'ble Court that the investigation will be completed as expeditiously as possible and an appropriate report U/sec.173 Cr.P.C. will be filed before the concerned Hon'bel Court by following the due process at the earliest. In view of the above reasons, I pray this Hon'ble Court to grant some more time to the investigating agency to complete the full-fledged investigation of the case.

To bring pressure on the investigating agency, the petitioner made baseless allegations against the respondent police in the affidavit and hence no credence can be given to it."

On noticing the above said instructions, learned counsel for the petitioner has requested this Court to dispose of the writ petition by recording the said instructions with a further direction to the police authorities to file final report

into the Court, as expeditiously as possible. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 22-09-2015 furnished by the Sub-Inspector of Police, Abid Road Police Station, Hyderabad and the respondent police authorities are directed to file final report to the Court in Crime No.103 of 2015, as expeditiously as possible.
