THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY APPEAL SUIT No.898 OF 2017 JUDGMENT:

None appears on behalf of the appellants. As per the proceedings dated 15.02.2023, despite the fact that suit was directed to be listed under the caption 'for dismissal', there was no representation. Earlier also, though there was order for payment of batta, the appellants failed to pay batta. Accordingly, notice to the respondents could not be issued. Therefore, having regard to the proceedings dated 15.02.2023, since there is no representation on behalf of the appellants, this Appeal Suit is dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no orders as to the costs. As a sequel, miscellaneous applications, if any pending, shall stands closed.
