THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.8335 OF 2015 ORDER:
The Criminal Petition is filed by the petitioners/A-3 and A-4 under Section 482 of the Code of Criminal Procedure, 1973 seeking to quash the proceedings in C.C.No.475 of 2015 on the file of the II Additional Judicial First Class Magistrate, Madanapalle, Chittoor District.
2. Heard both sides.
3. A charge sheet came to be filed against the petitioners and two others for the offences punishable under Sections 498-A and 323 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961. Though various grounds are raised in the petition, learned counsel for the petitioners restricts his prayer seeking to dispense with the presence of the petitioners before the trial Court and also to give liberty to avail the remedy of filing an application of discharge before the trial Court.
4. Accordingly, the Criminal Petition is disposed of dispensing with the presence of the petitioners in C.C.No.475 of 2015 on the file of the II Additional Judicial First Class Magistrate, Madanapalle, Chittoor District except on the dates when their presence is specifically required and also giving liberty to the petitioners to file an application for discharge if the charges are not yet framed.
5. Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
