This Criminal Petition is filed before this Court seeking to enlarge the petitioners/accuse Nos.4 to 6 on bail in the event of their arrest in Crime No.238 of 2025 of Khairatbad Police Station, Hyderabad.

The case of the prosecution is that the de-facto complainant, who is the brother of the deceased, lodged a report before the police stating that his brother committed suicide due to the harassment by accused Nos. 1 to 6. It is stated that a dispute arose between the accused and the deceased regarding the installation and removal of the Bonalu banner at the Khairatabad Gajjalamma Temple. Thereafter, Accused No. 4 went to the shop of the deceased, threatened him, and also abused him in filthy language, as a result of which, the deceased committed suicide. The complainant registered the case against the accused persons, basing on the said complaint; the Police registered a case in crime No.238 of 2025.

Heard Sri P. Srihari Nath, learned counsel for petitioners, and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondentState. 4.
Learned counsel for the petitioners contented that accused Nos. 4 to 6 nowhere connected with the said allegations and there was no intention to beat the deceased or cause him to commit suicide, and there is no proximity between the said allegations and the death of the deceased. Further, it is contended that the material part of the investigation is completed. The custodial interrogation is not necessary, as such, requested the Court to grant anticipatory bail in the event of their arrest. 4.
On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners and submitted that serious allegations are made against the petitioners and requested that the petition be dismissed.

Considering the submissions made by both the learned counsels and the material available on record, the petitioners are accused Nos. 4 to 6. The allegations against the petitioners are that they threatened the deceased, due to which, he committed suicide. Since the investigation conducted by the Investigating Officer and 14 material witnesses have already been examined, custodial interrogation is not necessary.

Considering the circumstances of the case, in the event of the petitioners' arrest, this Court deems it fit to grant anticipatory bail to them, subject to the following conditions.
i.
The petitioners herein shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the SHO, Khairtabad Police Station, Hyderabad.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
