THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.26144 OF 2009 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ of Mandamus or any other appropriate Writ, Order or direction declaring the Memo.No.L & O/ A-2/258/1998-2009 dated 26-11-2009, passed by the Commissioner of Police, the 1st respondent herein, rejecting the application made by the petitioner for grant of entertainment license and also not permitting the petitioner to conduct Bar and Restaurant business with live band/Orchestra/singing with male & female artists in the petitioner's premises as illegal, arbitrary, discriminatory, in violation of Article 14 and 19 (1) (g) of the Constitution of India, and contrary to the provisions of Hyderabad City Police Act, and quash the same and consequently direct the respondents herein, to allow the petitioner herein, to conduct its Bar and Restaurant business with live band/Orchestra/singing with male & female artists up to p.m in the petitioners premises by granting entertainment license."

The petitioner approached this Court with a prayer to direct the respondents not to interfere in its business since it is having valid license up to the year 2010. This Court also granted interim order directing the respondents not to interfere with the business of the petitioner herein provided the petitioner does not resort to unlawful activities. Admittedly, the license granted to the petitioner is valid up to the year 2010. Therefore, nothing survives for adjudication in this writ petition and hence, no further orders are required to be passed in this Writ Petition.

Accordingly, the Writ Petition is disposed of as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
