HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 8743 OF 2004 ORDER :
When the matter is taken up for hearing, the Standing Counsel for the respondents submitted that the petitioner has attained the age of superannuation and the petitioner is challenging the orders passed by the Industrial Tribunal in ID No.32/2002, dated 1.8.2003 wherein no relief was granted by the Industrial Tribunal when he challenged his removal order before the Industrial Tribunal cum Labour Court. Challenging the same, the present Writ Petition is filed.

The Standing Counsel for the respondents further submits that the relief sought for by the petitioner for reinstatement, at this point of time, cannot be granted as the petitioner has attained the age of superannuation. 3.
This Court is of the considered view that the relief sought for by the petitioner at this point of time, cannot be granted. However, this Writ Petition can be disposed of, directing the petitioner to make a representation seeking for the service benefits for the service rendered with respondents prior to his removal, if not already paid, within a period of two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider and pass appropriate orders within a period of four weeks thereafter.

With this observation, the Writ Petition is disposed of. 5.
