Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus directing the respondents to accept the market value prevailing in the year 1983 and consequently to direct the respondents to return the excess amount of Rs.90,725/- collected by the respondents forthwith to the petitioner and to set aside the notice dated 04-03-2004 as illegal, arbitrary and violative of principles of natural justice.

Though various grounds are raised in the writ petition, learned counsel for the

petitioner restricts his prayer seeking a direction to the 2nd respondent to consider and dispose of the representation dated 06-11-2004 said to have been made by the petitioner seeking return of excess amount paid by him on 29-032004. No counter has been till today by the respondents denying the averments of the writ affidavit.

Having regard to the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed of directing the 2nd respondent to dispose of the representation dated 06-11-2004 said to have been made by the petitioner, in accordance with law, within a period of 12 weeks from the date of receipt of a copy of the order. It is needless to state that the petitioner shall make a fresh representation, if the representation already made is not available in file. There shall be no order as to costs.
