THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CIVIL REVISION PETITION NO.1116 OF 2017 ORDER:

This revision is filed by the petitioners/plaintiffs under Article 227 of the Constitution of India seeking a direction to the Additional District Judge-cum-Special Judge for Trial of cases under S.C & S.T. Act, Srikakulam District, to dispose of the suit O.S.No.24 of 2011 as expeditiously as possible. 2.

The contention of the learned counsel appearing for the petitioners/plaintiffs is that they filed the above suit for partition and the same is pending for more than six years without any progress. This Court on 10-03-2017 called for the report of the Presiding Officer, who submitted his report on 21-03-2017, wherein it is noticed that the Court is having pendency of old matters and the concentration was on the suits filed prior to the present suit. It is also noticed that one of the defendants died and the matter was adjourned for several times for taking steps to implead the legal representatives of the deceased defendant.

Taking into consideration the above facts and circumstances of the case, the Civil Revision Petition is disposed of directing the Additional District Judge-cum-Special Judge for Trial of cases under S.C & S.T. Act, Srikakulam District, to dispose of the suit O.S.No.24 of 2011 as expeditiously as possible. No order as to costs. Miscellaneous petitions, if any pending in this revision shall stand closed.
