HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Contempt Case No. 1760 of 2017 Order:

This Contempt Case is filed alleging non-implementation of the orders of this Court passed in WPMP No.24691 of 2016 in WP No.6957 of 2016 dated 19.09.2016.

Pursuant to the notice in the present Contempt Case, the Contemnor is present and submitted that the company where the petitioner previously worked is not solvent, but not closed as on today. The company is paying the provident fund amount and 50% of the leave encashment amount to all the employees and it is not in a position to pay gratuity and balance 50% of the leave encashment amount and revival package is pending before the Union Cabinet. As and when orders are issued in respect of the revival package or otherwise they are ready to pay the amount due to the retired employees including the petitioner. In the circumstances, they state that the order could not be implemented. Since the main Writ Petition is pending, the petitioner can ventilate his grievance in the main Writ Petition and, in view of the position explained by the Contemnor, the Contempt Case is closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous applications, if any, pending in this Contempt Case shall stand closed.
