THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 28180 of 2019 O R D E R:

Petitioner asserts that he approached respondent No.2-Public Information Officer, O/o. Additional Deputy Commissioner of Police, Central Armed Reserve Head Quarters, Goshamahal, Hyderabad, for furnishing information with regard to service particulars and appointment order of Sri Koti Reddy, Police Constable, Hyderabad City Police, City Security Wing CAR, Goshamahal, Hyderabad, under the Right to Information Act, 2005 (for short 'the Act') and that as the said information was not furnished within the statutory period, he filed first appeal on 12.02.2019 and as the same was not being disposed of, he filed second appeal on 05.04.2019 and no orders have been passed thereon till date.

However, through communication, dated 22.06.2019, respondent No.2 had informed him that as of now, the person, in respect of whom the information was sought, did not give consent for furnishing the information in relation to his service. In the circumstances, he prays for a mandamus directing the respondents to furnish the information as sought by him.

Having considered the submissions of the learned counsel for the petitioner and considering the fact that respondent No.2 through communication dated 22.06.2019 intimated the petitioner under what circumstances the information as sought by him cannot be furnished, no useful purpose would be served if directions are issued to the first and second appellate authorities at this stage to pass orders in the

appeals. If the petitioner is aggrieved by the same, he had a remedy of appeal under the Act and on filing such appeal, the appellate authority shall consider and dispose of the same expeditiously within the time-frame provided under the Act.

Subject to the above, the writ petition is disposed of. Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs.
