THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.36610 OF 2015 O R D E R :

The grievance of the petitioner in this writ petition is that the stay petition filed by the petitioner in the appeal filed by him before the 2nd respondent challenging the order of the 3rd respondent in Rc.No.1374/2015 CS, dt.9.09.2015, is not been disposed of by the 2nd respondent.

2. Petitioner contends that although the appeal and the stay petition have been filed on 09.10.2015, the inaction of the 2nd respondent in disposing of the same, in spite of the fact that one month period has elapsed since then, is arbitrary and illegal.

3. The learned Government Pleader for Civil Supplies appearing for the respondents states that the 2nd respondent would consider the stay application in the appeal filed by the petitioner within two weeks and he will also dispose of the appeal within eight weeks.

4. In view of the said submissions, this Writ Petition is disposed of directing the 2nd respondent to consider and dispose of the stay application filed by the petitioner in the appeal filed by him challenging the order of the 3rd respondent within two (02) weeks from the date of receipt of a copy of this order and he shall also dispose of the appeal within eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
