The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 2nd respondent in not disposing the appeal in Rc.D2/4021/2012, dated 05-09-2012 filed against granting of assignment in favour of 4th respondent as illegal and arbitrary and consequently to direct the respondents not to interfere with peaceful possession and enjoyment of the petitioners property in Survey No.168/3 admeasuring Ac.5.09 cents situated at Thalpuru village, Atmakuru Mandal, Ananthapur District.

2. When the matter is taken up for hearing, learned counsel for the petitioner submits that though an appeal was filed in the year 2012, till date no orders are passed thereon. On the other hand, learned Government Pleader for Revenue states that a direction may be given to the 2nd respondent-Revenue Divisional Officer, Ananthapur to dispose of the appeal if the same is still

pending with him.

Without going into the merits of the case and having regard to the submissions made by the counsel for the parties, the writ petition is disposed of directing the 2nd respondent-Revenue Divisional Officer, Ananthapur to dispose of the appeal in Rc.D2/4021/2012, dated 05-09-2012 preferred by the petitioners, in accordance with law, if the same is still pending, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of the order. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
