THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13047 OF 2016 ORDER:
This petition is filed by the petitioner-accused No.3 under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.559 of 2016 on the file of Sanjeeva Reddy Nagar Police Station, Hyderabad, registered for the offence punishable under Section 420 IPC. Heard and perused the material available on record. It is alleged that the petitioner and other accused are running Sri Oversees Consultancy and they are offering to provide jobs in Coastal Marine Sea company and they took interviews over phone and gave selection letters in the name of Coastal Marin Sea Company and took all the relevant documents and documentation charges from the candidates. Believing their version, the complainant along with 9 members went to Bangkok on Tourist Visa and paid an amount of Rs.24,90,000/- to Mr. Mithun, Mr. Tapan and Mohit.
Subsequently, the complainant and others came to know that the offering letters are fake one. Learned Counsel for the petitioner submitted that the petitioner is also a victim and he is also a complainant in the complaint lodged before the concerned local police authorities at Bangkok. Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations in the complaint cannot be decided by this Court. Considering the facts and circumstances of the case and the nature of offence, this Court is not inclined to grant the relief sought by the petitioner. However, the 1st respondent-police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner.
respondent-police are directed to issue notice to the petitioner to appear before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating agency and give an undertaking as to his future appearance as and when required for the purpose of investigation.
