THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY AND THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.39465 of 2016 23.11.2016 Between:

M.Satya Anvesh ..Petitioner And The State of Andhra Pradesh, represented by its Principal Secretary, Home Department, Hyderabad and others ..Respondents Counsel for the petitioner: Dr.J.Vijaya Lakshmi Counsel for respondent Nos.1 to 3: Assistant Government Pleader for Home (AP) Counsel for respondent No.4: -- The Court made the following:

CVNR, J & MSKJ, J W.P.No.39465 of 2016 23.11.2016 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of Habeas Corpus to respondent No.4 for producing Ms.Anusha, wife of the petitioner. 2.

Today, respondent No.4 has produced his daughter - Ms.Anusha. We have interviewed her in the Chambers. While admitting that she has married the petitioner, Ms.Anusha has, however, stated that the petitioner has cheated her into believing that he has B.Tech. (I.I.T.) qualification and that he has been pursuing his Masters in Engineering and on coming to know about the fact that he does not have such qualifications, she is not willing to join him. She has further stated that she is voluntarily staying with her parents.

3.

In view of the aforementioned opinion expressed by Ms.Anusha, we are convinced that she is not illegally detained by respondent No.4. Hence, the relief claimed in this writ petition cannot be granted. 4.

Accordingly, the Writ Petition is dismissed, however, with liberty to the petitioner to avail appropriate legal remedies as the husband of Ms.Anusha, who is admittedly a major.

5.

As a sequel to dismissal of the writ petition, W.P.M.P.No.49450 of 2016 filed by the petitioner for receiving document shall stand dismissed as infructuous.
