THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10263 OF 2015 ORDER:
This Criminal Petition is filed by the petitioner-A1, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in CC No.869 of 2014 on the file of Additional Judicial Magistrate of First Class, Nuzvid Krishna District, arising out of Crime No.129 pf 2011 of Nuzvid Town Police Station, Krishna District, registered for the offences punishable under Sections 420, 465, and 419 read with 34 IPC. Heard and perused the material available on record. The allegation against the petitioner is that she impersonated and sold away the share of the land of the de facto complainant by forging her signatures. Learned counsel for the petitioner submitted that the investigation of the case is completed and the charge sheet has been filed and as the petitioner was shown as absconding, NBW was issued against her and therefore, she may be granted anticipatory bail.
In view of the submission made by the learned counsel for the petitioner, this Court is of the view that this criminal petition can be disposed of with the following directions:
The petitioner-A1 is directed to appear before the Court concerned and file an application to recall the NBW pending against her and on filing of such application, the Court concerned is directed to recall the NBW on the same day on condition of petitioner executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum and further the petitioner is directed to appear before the Court concerned as and when required.
