HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 25954 of 2006 ORDER:
This writ petition is filed, under Article 226 of the Constitution of India, by the petitioner seeking a writ of mandamus to declare the action of the respondents in contemplating to dispossess him from the land of an extent of Ac.1.49 cents in Survey No.104 situated at Pinnamareddypalli Village, pursuant to notification dated 10.09.2006, as published in Andhra Prabha Telugu daily newspaper, as illegal, arbitrary and without jurisdiction. A consequential direction is also sought to quash the notification by directing the respondents to drop the acquisition proceedings initiated against the said land. 2.
Heard Sri Nimmagadda Satyanarayana, learned counsel for the petitioner, and the Government Pleader for Land Acquisition (AP) appearing for the respondents.

Learned Government Pleader for Land Acquisition (AP) appearing for the respondents has brought to the notice of this Court that the respondents are not intending to acquire the land of the petitioner.

Recording the aforesaid submission made by the learned Government Pleader, the writ petition is allowed and the impugned notification dated 10.09.2006 is set aside.
