Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an appropriate writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in constitutional violations of Articles 14, 16 & 21 of the Constitution of India and violations of Section 148 CPC & Order XVII Rule 1 & 2 of Civil Procedure Code and non-compliance of the orders of Hon. High Court in CRP 3695 of 2009 as illegal, arbitrary and in relation of natural justice. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Dr. M. Ram Mohan Rao, Party-in-Person as Petitioner, the Court made the following Dr. M.
Ram Mohan Rao - party in person would submit that O.S.No.938 of 2008 has been pending on the file of the VIII Addl. Senior Civil Judge, Rangareddy District ever since 2008; despite a direction of this Court in C.R.P.No.3695 of 2009 dated 4.3.2010 that hearing of the said suit be expedited, the matter is at the stage of recording additional evidence of the defendant.
Registrar (Judicial) shall ascertain the year-wise pendency of cases in the said court and submit a report to this Court within two weeks. Post on 7.3.2013.
