THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11340 OF 2025 ORDER:

This Criminal Petition is filed before this Court seeking to enlarge the petitioner/accused on bail in the event of his arrest in complaint given on the file of SHO, Adilabad I-Town Police Station, Adilabad District. 2.

The case of the prosecution is that the de facto complainant lodged a report before the Police on 05.08.2025, stating that the petitioner herein encroached upon land belonging to the Red Cross Society. When he questioned the same, the petitioner herein threatened to kill the de facto complainant. However, he requested the police to take necessary action against the petitioner herein.

Heard Sri S.Ravi Kiran Reddy, learned counsel for petitioner, and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner contended that, based on the said complaint, though no crime has been registered against the petitioner, the petitioner is apprehending of arrest by the Police. He further contended that the Investigating Officer is calling the petitioner to the police station every day and harassing him. As such, he requested the Court to grant anticipatory bail in the event of his arrest. 4.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner and submitted that as no crime is registered and there is no apprehension of arrest and requested the Court to dismissed the Criminal petition. 5.

Considering the submissions made by both the learned counsels and the material available on record, there is a report filed by the complainant that this petitioner threatened the complainant and basing on the same petitioner herein also filed Writ Petition before this Court, wherein this Court directed the respondents to follow due process as contemplated under law before

initiating any action on the petitioner herein and disposed of the said writ petition.

Considering the circumstances of the case, in the event of the petitioner's arrest, this Court deems it fit to grant anticipatory bail to him, subject to the following conditions:

i.

The petitioner herein shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the SHO, Adilabad I- Town Police Station, Adilabad District.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
