THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29247 of 2015 ORDER:

Heard the learned counsel for petitioner, the learned Government Pleader for Civil Supplies for respondents 1 to 5 and the learned counsel for respondent No.6.

2. The petitioner was appointed as a temporary fair price shop dealer o f Tadakaluru Village, Dagadarthi Mandal, Nellore District on 03.12.2010. In her order of appointment itself, it was stated that her appointment is for a period of three months or till permanent arrangements were made. However, when she indulged in certain irregularities, the sixth respondent was appointed, by proceedings of the fourth respondent dated 21.04.2015. Challenging the appointment of the sixth respondent, the petitioner filed an appeal before the third respondent along with stay application and the third respondent rejected the stay application, by proceedings dated 10.07.2015, while calling for the record from the fourth respondent. The appeal before the third respondent is pending.

3. In view of the pendency of enquiry before the third respondent, this Court is not inclined to go into merits of the case at this stage. Hence, the writ petition is disposed of at the admission stage directing the third respondent to dispose of the appeal preferred by the petitioner on 29.04.2015, as expeditiously as possible, but not later than 30 days from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
