THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.28209 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for shop No.10 for 7th Ward, Kosigi Village and Mandal, Kurnool District.

The authorization of the petitioner is in possession was renewed upto 31.03.2015 and he applied for renewal of the same on 11.02.2015. A show cause notice was issued by the 3rd respondent to the petitioner on 25.07.2015 levelling 4 charges against him and the petitioner submitted his explanation on 29.07.2015. Now a final order of cancellation of authorization was passed on 19.08.2015. Against the said order, the petitioner preferred an appeal to the 2nd respondent on 24.08.2015 and also filed the present writ petition.

In view of the pendency of the appeal before the 2nd respondent, this Court is not inclined to go into the merits of the case, though the learned counsel for the petitioner submitted no enquiry was conducted in respect of the allegations as per the provisions of Andhra Pradesh State Public Distribution System (Control) Order, 2008.

In the circumstances, the 2nd respondent is directed to take up the appeal and pass appropriate orders thereon in accordance

with law within a period of two (02) months from the date of receipt of a copy of this order. The 2nd respondent also shall consider the stay petition filed by the petitioner in pending appeal and pass appropriate orders thereon within a period of one week from the date of receipt of the order.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. _______________________________ A. RAMALINGESWARA RAO, J Date: 02.09.2015 gvl
