SEETHARAMA MURTI WRI T PETI TI ON No.28696 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed seeking a writ of habeas corpus for the production of the petitioner's wife, Vaishnavi Laddha @ Kausar Fatima, the daughter of the 5th and 6th respondents, so as to enable her to join the petitioner in her matrimonial home.

Notice having been ordered, respondents 5 and 6 entered appearance through counsel, Sri P. Venkata Rao. On 14.09.2016, this Court directed respondents 5 and 6 to produce the alleged detenu, Vaishnavi Laddha, who was in their custody, on 22.09.2016.

Today, respondents 5 and 6 along with Vaishnavi Laddha, the detenu, are present in person and in camera proceedings were held with them and also the petitioner, the husband of the alleged detenu. Vaishnavi Laddha, the alleged detenu, stated that she is 24 years of age and has completed B.Tech. She further stated that she married the petitioner out of her own choice and that, though she was with her parents presently and was not being held against her will, she would like to join her husband, the petitioner herein.

Respondents 5 and 6 stated that they have no objection if the petitioner wishes to join the company of her husband but they would not wish to have anything further to do with her thereafter. They have also stated that in the event their daughter, Vaishnavi Laddha, chooses to go

with the petitioner, they would see that her belongings were sent to the house of the petitioner.

In that view of the matter, the Writ Petition is allowed. Vaishnavi Laddha, the daughter of the 5th and 6th respondents, is permitted to join the company of her husband, the petitioner herein, who undertakes to take good care of her and care for her happiness and well being. The undertaking of respondents 5 and 6 that they would be transferring the belongings of Vaishnavi Laddha, their daughter, to the house of the petitioner, is also taken on record.
