HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 32175 of 2017 ORDER:

The case of the petitioner that he joined as a clerk in the Primary Agriculture Cooperative Credit Society on 16-10-2000 and promoted to the post of Chief Executive Officer after nine years of service. The respondent-bank issued recruitment notification dated 31-08-2017 for filling up of Staff/Assistants/Clerks and in previous notification dated 12-09-2011 for filling up of Staff Assistant posts, the petitioner applied and could secured good marks. As per notification, for the in service candidates 25% of total vacancies were earmarked and it is sufficient if an incumbent secures minimum qualifying marks. The petitioner came to know that he is placed at Sl.No.2 in service candidates list. But the petitioner could not get posting.

One Pradeep was given appointment, who is far junior to the petitioner and as per the Notification the incumbent should fulfill the condition of putting in minimum qualifying service of 10 years in the concerned credit society.

In the waiting list from Sl.No.27 is retired, if the respondents did not give appointment to the person who has submitted fake service certificate, the petitioner would have got the appointment as per notification dated 12-09-2011. Now the respondents have included the said vacant post which arose due to removal of said Mr.Pradeep Kumar Reddy for producing fake certificate and had the petitioner representation been considered, he could have been filled up in that post. Aggrieved by the same, the present writ petition is filed.

Sri S.Dushyanth Reddy, learned Standing Counsel for respondent No.3 submits that no exparte orders can be granted at this stage.

On the other hand, learned counsel for the petitioner submits that petitioner will make necessary application to the 3rd respondent.

In view of the same, it is open for the petitioner to make representation stating above facts and respondent No.3-bank is directed to dispose of the same in accordance with law before filling up posts by it according to subsequent notification.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
