THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.11907 of 2003 ORDER:

This writ petition is filed to declare show cause notice Nos.1/2003, 2/2003 & 3/2003, dated 10-06-2003, which were issued in compliance of order in R.C.No.1728/2002-C, dated 09-05-2009 of second respondent as illegal, arbitrary, unjust and violative of Articles 14 & 21 of the Constitution of India.

2. Petitioners 1 & 2 herein are working as Clerks and third petitioner is working as Attender on the date of issue of show cause notices. The first respondent filed counter stating that the appointment of these three persons were purely in accordance with rules governing recruitment and no illegality or irregularities were committed and in view of the expansion of the business and increase of the turnover, the assistance of the existing staff including the writ petitioners is very much necessary for discharge of its responsibilities, multifarious functions effectively and smoothly.

3. This Court, granted interim orders on 26-06-2003 in WPMP No.14811/2003, directing the respondents to maintain status-quo and that, order does not preclude the respondents from giving effect to Section 116 (c) of A.P. Cooperative Societies Act duly following the procedure in case the salary bill exceeds the limit stipulated therein.

4. It is represented that all the petitioners are still continuing and working without any remarks.

5. In view of the specific plea taken in the counter that the presence of petitioners as employees is required for discharge of the responsibilities, multifarious functions of the first respondent effectively and smoothly, both advocates submitted that no further orders are necessary and that this writ petition can be closed by confirming the interim orders dated 26-06-2003.

6. Writ Petition is closed accordingly. No costs.

7. As a sequel, miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed.
