This Writ Petition came to be filed with the following prayer:

"...to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inordinate delay and inaction of the Respondents particularly 4th Respondent herein in failure to permit the Petitioner for de-casting of ordinary earth (Busaka) from the patta land admesuring Ac.5-60 cts in R.S. No.347 situated in South Valluru village, Thotlavalluru Mandal, Krishna District without considering the application dated 4/1/2015 pending before the Assistant Director, Mines and Geology, Vijayawada, the 4th Respondent herein as arbitrary, illegal and violative of the fundamental rights guaranteed to the writ petitioner Articles 14, 19 and 21 and the constitutional guarantee guaranteed under Article 300-A of Constitution of India with a consequential direction to the Respondents herein to grant permission to the Petitioner for de-casting of ordinary earth (Busaka) from the patta land admeasuring Ac.5-60 cts in R.S. No.347 situated in South Valluru village, Thotlavalluru Mandal, Krishna District in the interest of justice and pass..."

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Mines and Geology for the State of Andhra Pradesh appearing for respondents. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. Though various grounds are urged in the Writ Petition, learned counsel for the petitioner seeks a direction to respondent No.4 to pass appropriate orders on the application dated 04.01.2015 made by the petitioner for de-casting of ordinary earth (Busaka) from the patta land admesuring Ac.5-60 cts in R.S. No.347 situated in South Valluru village, Thotlavalluru Mandal, Krishna District. Learned Assistant Government Pleader submits that respondent No.4 has to take appropriate decision on the application of the petitioner.

4. Having regard to the circumstances of the case, the Writ Petition is disposed of directing respondent No.4 to pass appropriate orders on the application dated 04.01.2015 made by the petitioner in accordance with law, within a period of two weeks from today. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order.
