THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CIVIL REVISION PETITION No.3974 of 2015 ORDER:
This civil revision petition under Article 227 of the Constitution of India is filed by the plaintiff in OS.No.108 of 2013 on the file of the Court of the Agent to Government at Khammam to direct the Court below to expedite the hearing and disposal of the suit and decide the same on merits as expeditiously as possible.
2. I have heard the submissions of the learned counsel for the revision petitioner. I have perused the material record.
3. The only grievance of the revision petitioner/plaintiff in this revision is that though the suit is of the year 2013 no steps so far have been taken as per the procedure established by law for proceeding with the trial of the suit and that the inordinate delay in disposal of the suit is causing hardship to the revision petitioner/plaintiff.
4. In the facts and circumstances, this Court is of the considered view that this revision can be disposed of at the admission stage giving a direction to the Court below to decide, within a time frame, the above said suit on merits and in accordance with the procedure established by law, as such a course meets the ends of justice.
5. In the result, the Civil Revision Petition is disposed of and the Court below is directed to decide the suit-OS.No.108 of 2013 on merits and in accordance with the procedure established by law as expeditiously as possible and preferably within a period of three (03) months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this CRP shall stand closed.
