Mr. M.M.M.Srinivasa Rao, after arguing the writ petition for some time, submits that the petitioner does not have claim or possession of Government land in Sy.No.80 of Panduranga Puram Village, for which the notice under Section 6 of the Land Encroachment Act, 1905 is issued. According to him, the petitioner is in possession of land measuring Ac.5.18 guntas in Sy.No.95/ A of Panduranga Puram Village. If the authorities survey, identify and demarcate Sy.No.80 with reference to Village Map and Field Map, then the authorities can take possession of Sy.No.80. He further contends that by reference to notice issued in respect of Sy.No.80, the respondents cannot disturb the possession of petitioner of Sy.No.95/ A.
2. The submission of learned counsel appears to be reasonable and this court is of the view that 3rd respondent while implementing the notice issued under Section 6, undertakes survey of both the survey numbers, delineates and takes possession of land in Sy.No.80.
3. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
