THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.10154 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.382 of 2023 on the file of Amberpet Police Station, Hyderabad, registered for the offences under Sections 304-B and 498-A of IPC r/w. 302 and 34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Briefly, the prosecution case is that A-1 married to deceased and at the time of marriage dowry was given. A-1 to A-3 were staying at Amberpet area. It is alleged that A-1 to A-3 who are husband, father-in-law and this petitioner who is the sister-in-law were harassing for additional dowry for which reason an amount of Rs.20,000/- was initially given. Thereafter, harassment continued for
getting an additional dowry of Rs.2,00,000/-. The petitioner, A-1 and the deceased started living separately in a portion in the house of L.W9. It is alleged that since the deceased was refusing to have physical relation with A-1, he developed grudge against her. Thereafter, she was found dead. Since this petitioner was admittedly staying at Malakpet and was already married before the marriage of the deceased and A-1 had taken place and since the allegation of abetting A-1 for additional dowry, the petitioner can be granted the relief of regular bail, subject to following conditions:
i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of IV Additional Chief Metropolitan Magistrate, Hyderabad.
ii) The petitioner/Accused No.3 after release shall appear before the concerned Station House Officer as and when required, for the purpose of investigation.
iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
